PHOTOGRAPHY SERVICES AGREEMENT

DFW Pixel Promise

This Photography Services Agreement (“Agreement”) is entered into between DFW Pixel Promise (“Photographer”) and the undersigned client (“Client”).

1. SERVICES PROVIDED

Photographer agrees to provide photography services for the Client according to the agreed session details, package selection, schedule, and deliverables discussed prior to the event or session date.

2. BOOKING FEE & PAYMENT

A 50% non-refundable booking fee is required to secure the session or event date. No date is reserved until the booking fee and signed Agreement are received.

If the Client cancels the session/event before ____________ (date), the booking fee remains non-refundable.

The remaining balance is due no later than ____________ unless otherwise agreed in writing.

Late payments may delay image delivery.

3. DELIVERY TIMELINE & CLIENT DELAYS

Photographers will make reasonable efforts to deliver edited images within the estimated delivery timeframe communicated to the Client.

If Client approval or input is delayed beyond 3 business days, the delivery deadline will be extended by an equal timeframe.

Photographer is not responsible for delays caused by lack of communication, delayed selections, or missing information from the Client.

4. LOCATION PERMISSION & ACCESS

Client confirms they have permission to use all proposed photography locations.

Photographers are not liable if access is denied, restricted, interrupted, or revoked at any location.

Any fees, permits, parking costs, or permissions required for location access are the responsibility of the Client unless otherwise agreed in writing.

5. MEAL PROVISION FOR LONG SESSIONS

For photography sessions or events exceeding 6 hours, Client agrees to provide a meal for Photographer and any photography team members.

The meal provided should be reasonably equivalent to what is served to guests or participants at the event.

6. EDITING & REVISION POLICY

Photographer maintains creative control over image editing style and final image selection.

Package pricing includes one round of minor editing adjustments.

Additional revision requests beyond the included round will be billed at $50 per hour.

Major retouching requests, composite editing, or extensive modifications may require additional fees.

7. COPYRIGHT & PORTFOLIO USAGE

Photographer retains all copyrights to the images created during the session.

Photographers retain rights to use images for portfolio, website, social media, marketing, advertising, and promotional purposes.

Commercial client usage beyond standard personal or agreed business use may require a separate licensing agreement.

Client may not sell, alter, edit, or submit images for commercial publication without written consent from Photographer.

8. LIMITATION OF LIABILITY

In the unlikely event of equipment failure, accident, illness, emergency, or circumstances beyond Photographer’s control, liability is limited to the return of all payments received.

Photographer is not responsible for compromised coverage caused by:

Weather conditions     Venue restrictions    Guest interference Schedule delays    Lighting limitations    Client lateness

9. MODEL RELEASE

Client grants Photographer permission to photograph participants involved in the session/event and to use those images as outlined in this Agreement unless otherwise stated in writing before the session date.

10. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions or agreements.

Any modifications must be made in writing and signed by both parties.
